Does Everyone Get Bail?
First, there is a possibility that you might not have a bond amount set at all. This could either be a good thing or a bad thing. For example, you might be released from jail without having to post bail at all. This is usually reserved for low-level offenses. In this case, you will be released ROR, which stands for “released on your own recognizance.” You promise to show up for your trial if your case gets that far. If you do not show up for your trial, then a bench warrant will be issued for your arrest.
On the other hand, you might also be held without bail. In this case, the term is “remanded.” This is only used for capital level offenses such as murder. Otherwise, you will have a bail amount posted.
What if Bail Is Set?
In the vast majority of cases, you will be allowed to leave jail pending trial but you will have to pay something. This might be $20 or it could be more than a million dollars. Some of the factors the judge will consider when deciding how to set your bail include the nature of the offense with which you are charged, your prior criminal record, your ties to the community, and your financial means. The more severe the charges against you, the higher your bail is going to be.
How Do I Get Out of Jail?
Once your bail has been set, the next step is to pay it. While you could pay your bail yourself, this is not the fastest way to get out of jail. You will find it hard to move around freely inside of jail, so it is better to work with a professional bondsman who knows the system. That way, you can prepare a strong defense from home.
